COMMON INJURIES IN REAR-END CRASHES:


Herniated, Ruptured, or Slipped Discs: The round, flat discs between the vertebrae in the spine, which are designed to absorb pressure and maintain the spine’s flexibility, can herniate, rupture, or slip out of place when the body experiences some sort of force or trauma.


Whiplash or Connective Tissue Injuries: Whiplash occurs when joints located between the vertebrae, discs, ligaments, muscles, and nerve roots in the neck become damaged.

Compression Fractures: Compression fractures can occur when the bones in the spine become broken due to trauma.

  

Head and Brain Injuries: This is one of the most common injuries suffered in a car crash. These injuries can range from mild concussions to traumatic brain injuries. Even when there is no physical sign of trauma, the brain is at risk of being moved inside the skull because of the impact of the car crash, so that bruising and other injuries can result.


Facial injuries (scrapes, bruises, lacerations and fractures):  Injuries of this type occur when you strike objects inside the car -- including steering wheels, dashboards, and airbags.  Jaw injuries, such as TMJ, and serious dental injuries are also uncommon.

Psychological injuries (emotional distress or PTSD:  A car crash can have long-term effects on your life. Drivers and passengers can suffer psychological injuries such as emotional distress, and can even develop post-traumatic stress disorder. Symptoms can include disturbing thoughts, feelings, or dreams related to the events, mental or physical distress to trauma-related cues, attempts to avoid trauma-related cues, and general alterations in how a person thinks and feels.

Question:  I felt fine just after the crash, but now I'm sore. Do I still have a claim?


Answer:  It's not uncommon to feel fine immediately afterward, but develop symptoms over the next few days.  If you have pain after an accident, whether it's immediate or even a few days later, you should seek medical attention. If the crash was the cause of the injury, the driver at fault is liable for them.


Question:  My car has very little visible damage. Will that affect my case?


Answer:  No. The visible damage to your vehicle isn't necessarily indicative of the injuries you've suffered. We've all heard of people who've been in bad crashes with totaled cars, but have walked away unharmed. Likewise, the opposite can be true. Even crashes that appear minor can have lasting effects on the people involved. 


Question:  How do I know who is at fault?


Answer:  Rear-end crashes usually offer a clear story as to who is at fault. While there can be exceptions, in most cases if you were struck from behind, the other driver is at fault. A quick way to determine fault is to examine the accident report. Almost all crash reports issued by law enforcement state which driver was at fault. In most cases the at-fault driver will receive a citation for failure to maintain an assured clear distance.


Question:  Should I speak to the insurance company?


Answer:  As a general rule, you have a duty to cooperate with your own insurance company, but you have no obligation to speak with the other driver's insurance company directly. In fact, insurance adjusters are trained to minimize crash victim recovery, and insurance companies typically do whatever it can to avoid giving you fair compensation. To avoid these issues, hire Baker & Roszczyk and we'll deal with the insurance companies for you. 


Question:  The other driver fled the scene. What should I do?


Answer:  As with all accidents you should file a police report. If you were got a license plate number, the police should be able track down the other driver. And even though the other driver fled the scene, you might be able to make a claim with your own insurance company for uninsured motorist benefits.


Question:  I was cited at the scene of the accident. Do I still have a case?


Answer:  If the citation you received is unrelated to the specific cause of the accident, you can still seek a full recovery against the driver who caused the accident.
